The Spanish Government approved on Saturday the 4th of July 2020 a new Royal Decree regarding the new regulation to get the new legal status in Spain for UK citizens.

As you already know, the UK will be leaving the EU by the 31ST OF DECEMBER 2020. During this time until the end of the year, UK citizens have to regularise their situation if they want to be resident in Spain and they don't want to become illegal in Spain as of the 1st of January 2021. The new TIE (foreigners identification card) will reflect your new status in the EU under the withdrawal agreement signed between the EU and the UK.

The situation of British citizens can be split into two big groups:

    A) All British citizens that HAVE the residencia card, it is highly recommended to exchange it into the new TIE card but it is not essential at this time.

If you wanted to exchange your residencia for the new TIE card you will require the information below,

- The official form filled in and signed
- A copy of all the pages of your passport including the covers
- Your padron certificate not older than three months (NOT a volante, it must be a certificate)
- 1 passport photo
- A copy of your residencia card. If you have lost it or has been stolen by somebody, a claim submitted at the Police Station due to loss or theft
- The tax paid: 12 Euros/person. Please, bring the copy duly stamped called "Ejemplar para la Administración"

If your residencia card is provisional, the new TIE card will have a validity of 5 years. Its renewal will be for 10 years.
If your residencia card is permanent, the new TIE card will have a validity of 10 years. Its renewal will be for 10 years.
In both cases they will have to be renewed before its expiry date.

    B) All British citizens that DO NOT HAVE the residencia card MUST apply for the new TIE card to avoid being illegal in Spain as of the 1ST OF JANUARY 2021.  You will need the information below to apply,

- The official form filled in and signed
- A copy of all the pages of your passport including the covers
- Your padron certificate not older than three months (NOT a volante, it must be a certificate)
- 1 passport photo
- If you WORK IN A SPANISH COMPANY: your work contract, your last payroll and your "vida laboral"
- If you are SELF-EMPLOYED: a copy of your registry as self-employed and the quarterly 130
